Prof Jimly Slams Administrative Court: Overturning UI's Ethics Sanctions Shows Judges Don't Get the Boundary Between Law and Ethics
Constitutional law expert Prof. Jimly Asshiddiqie has slammed the Jakarta State Administrative Court (PTUN) decision that overturned the ethics sanctions against the supervisor and co-supervisor of Bahlil Lahadalia's dissertation. He reckons the PTUN judges don't understand that a court of law has no authority to overrule an ethics ruling. "The case of the UI ethics verdict being overturned by PTUN just goes to show, once again, that administrative court judges are out of touch with the times," he stressed.
The administrative sanction from the UI Rector, which banned teaching and supervising for three years, was handed down because of special treatment given during Bahlil's doctoral studies. The two sanctioned academics then filed a lawsuit with the PTUN and won, so the UI Rector has appealed to the Supreme Court.
A total of 301 UI Professors filed an amicus curiae with the Supreme Court to overturn the PTUN decision, stressing that campus academic autonomy must be free from political and financial interference. Senior lawyer Todung Mulya Lubis emphasized that breaches of campus ethics are non-negotiable.
