Islamic human rights group seeks legal action over British nationals who fought with Israeli forces

LONDON: The International Centre of Justice for Palestinians has begun legal steps to bring a private prosecution against British nationals alleged to have fought for Israeli forces.
The group plans to argue in court that these Britons joined a foreign army taking part in hostilities with Palestine, a state with which the UK was not at war. An application for a summons against one named person was filed at a magistrates’ court on Monday, and the group says it has evidence relating to more than 10 British citizens, though only one individual was identified in the court papers to avoid prejudicing the case.
The ICJP says those who fought for Israeli forces breached Section 4 of the Foreign Enlistment Act 1870, which bars people from accepting military service for foreign states that are at war with a state at peace with the UK. The organisation contends Israel’s actions amount to a war against Palestine that affects the whole population and state, pointing to military operations in Gaza and actions in the West Bank.
To succeed, the ICJP will need to show the defendant is a British citizen who accepted service with Israel’s military, that Israel was at war with Palestine, and that Palestine was a foreign state not at war with the UK. The papers note Israeli law does not compel those outside Israel to serve, so any British nationals who fought would have done so voluntarily.
