Mahfud MD Reveals the Multiple Charges Threatening the Indonesian KPU Over Gibran’s Diploma
Constitutional law expert Mahfud MD broke down the potential layered criminal charges facing commissioners of Indonesia’s General Elections Commission (KPU) in the case over Vice President Gibran Rakabuming Raka’s diploma. He reckons the Constitutional Court’s decision not to disqualify Gibran was spot on-doing otherwise mid-process could’ve opened a real can of worms.
Mahfud pointed out the court’s ruling explains that Gibran never actually submitted his high school diploma, just an attendance letter from his school in Singapore. This, he said, opens the door for criminal charges against everyone involved, including the KPU, with articles ranging from the ITE Law, public deception, document forgery, all the way to the Election Law.
Besides the KPU, the Ministry of Primary and Secondary Education-formerly a directorate general-could also be on the hook for issuing that recommendation letter allowing attendance certificates as a requirement for the 2024 presidential election registration. The Constitutional Court’s ruling didn’t accept the lawsuit, but made clear they couldn’t find any evidence of a valid high school diploma.
