Here's the Order of a Woman's Marriage Guardian Complete with Valid Requirements
In Islam, the marriage guardian is one of the valid conditions for marriage, as the Prophet Muhammad (peace be upon him) said: 'There is no valid marriage except with a guardian' (narrated by Ahmad). The marriage guardian for a woman is divided into a guardian by blood (wali nasab), a guardian appointed by the government (wali hakim), a guardian appointed by the bride herself under certain conditions (wali tahkim), and a guardian for a female slave (wali maula, no longer relevant).
The order of blood guardians that applies in Indonesia according to Minister of Religious Affairs Regulation Number 30 of 2024 Article 12 is: biological father, grandfather (father's father), great-grandfather, full brother (same father and mother), half-brother from the father's side, son of the full brother, son of the half-brother from the father's side, paternal uncle (father's full brother), son of the full paternal uncle, son of the half paternal uncle from the father's side, grandson of the full paternal uncle, grandson of the half paternal uncle from the father's side, father's full paternal uncle, father's half paternal uncle from the father's side, son of the father's full paternal uncle, and son of the father's half paternal uncle from the father's side.
Requirements for being a marriage guardian are being Muslim, having reached puberty, being of sound mind, being free, and being just. If all blood guardians are absent or do not meet the requirements, the authority moves to the guardian appointed by the government through the local Office of Religious Affairs (KUA). If the guardian cannot attend, he can give written power of attorney through a guardian proxy letter (surat taukil wali).
For a woman born out of wedlock, she has no blood guardian from the father's side, so she must be married with a guardian appointed by the government through the local KUA.
